Terms of Use

These Terms of Use (“Terms”) govern your access to and use of apply.afecapitalconnect.com and the funding pre-qualification application available through it (together, the “Site”), operated by AFE Capital Connect (“AFE Capital,” “we,” “us”). By accessing or using the Site, or by submitting the application, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

The Site is intended for use by business owners and authorized representatives of a business, for the business purpose of exploring commercial financing options. It is not directed to, and should not be used by, consumers seeking personal, family, or household financing, or by anyone under 18.

AFE Capital is a connector, not a lender or a direct funding source. AFE Capital does not itself make loans, extend credit, or fund merchant cash advances. When you submit the application, AFE Capital shares your submitted information with third-party funding providers in its network for the purpose of identifying financing options that may fit your business.

Every funding decision — including eligibility, underwriting, approval, amount, pricing, and timing — is made solely by the third-party provider you’re connected with, under that provider’s own criteria and process, which AFE Capital does not control. Using the Site or submitting the application does not guarantee that you will be approved, matched with a provider, or offered any particular amount, terms, or funding speed. You agree to provide accurate, current, and complete information about yourself and your business when using the Site, and to promptly correct or update it if it changes. Third-party providers rely on this information to evaluate your inquiry; inaccurate information may delay, prevent, or invalidate a funding match.

Any financing offer, agreement, or transaction you enter into is between you and the third-party provider, not AFE Capital. AFE Capital is not a party to that agreement and has no obligation or liability under it. Review any offer and its full terms carefully, and direct questions about a specific offer to the provider that made it.

When using the Site, you agree not to:

• Submit an application on behalf of a business you are not authorized to represent, or submit false, misleading, or another person’s information;
• Use the Site for any unlawful purpose, or to submit a request for personal, family, or household financing rather than commercial financing;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its infrastructure, or any related systems;
• Use automated means (bots, scrapers, or similar tools) to access the Site outside of normal browsing, or to submit applications in bulk or on behalf of parties who have not authorized the submission; or
• Copy, reproduce, or create derivative works from the Site’s content for any purpose other than your own evaluation of financing options.

The Site and its content — including text, design, graphics, and the AFE Capital name and marks — are owned by or licensed to AFE Capital and are protected by applicable intellectual property laws. You may view and use the Site for your own personal or internal business purpose of exploring financing options; no other right or license is granted.

Content on the Site, including calculators, educational articles, and comparisons, is provided for general informational purposes only and does not constitute financial, legal, tax, or accounting advice. Consult a qualified professional about your specific situation before making a financing decision.

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any calculator, estimate, or piece of content is accurate, complete, or current for your circumstances.

To the fullest extent permitted by law, AFE Capital will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of the Site or any financing application, offer, or transaction with a third-party provider, even if advised of the possibility of such damages. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

By using the Site and submitting the application, you agree that we may communicate with you electronically, including by email and text message, consistent with the consent choices presented to you in the application, and that such electronic communications satisfy any legal requirement that communications be in writing.

We may modify, suspend, or discontinue any part of the Site at any time, and may update these Terms from time to time. Material changes will be reflected by updating the “last updated” date above. Continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
